Gunthor
Salve a tutti, Kindly answer in english as I do not understand Italian... My intention is to participate at the Sella Ronda Bike Day on 23rd June 2018. I have a written invitation from the organisation allowing me to participate with my electric unicycle. However, my understanding is, that EUCs are not allowed in Italy yet - is this still the case? If so, can you give me some advice how to deal with the poilzia just in case there will be an encounter... ? Saluti
LEO_LEO
hi @Bunthor , in italy is a roulette, if the policemen decide to stop you, it is possible you become our national hero as you become a public enemy, I think it depends from the wifes of the policemen, if day before they had headache there are not advices, you pay for all
FULspeed
Dear @Gunthor, It’s true, in Italy we don’t have any law covering EUC’s circulation, but normally if you don’t do anything strange (ie using your wheel on the road in the middle of the traffic...) you should not have problems. BTW, in this specific case, I read that the roads are open only for bikes, moreover you have also a written invitation from the organization.... so don’t miss this wonderful opportunity. The landscapes are fantastic and I would like to be in your place Ps: I see that you have a KS with 680wh, I hope you will not have autonomy problems with all that uphill road...

Gunthor
Dear @FULspeed and @MaxMi, Thanks for worrying that my KS16 is not the right EUC for Sella Ronda - you are absolutely right: I will get an Inmotion V10F within the next days and THIS will be my EUC for Sella Ronda. Indigo
@Gunthor, a question that is not related with Sella Ronda, but I'll take advantage of your presence here, as representative of German wheelers.. I heard that in your country our beloved wheels are clearly forbidden by law, is it true? If yes, how do you behave with polizei? Thank you! Gunthor
Dear @Indigo, the Polizei is a p@in in the @ss: They confiscated my Kingsong twice! I argue with a legal conception of a lawyer (Grosskopf) concerning EU decree 168/2013. So far I always got my EUC back without paying any fines (two days ago I was at the Polizei and got my wheel back the second time). However, in Germany no fundamental legal decision concerning "Do you need to insure EUCs or not?" exists and I don't want to be the monkey fighting for this. From my understanding it was clearly forbidden by national german law to ride EUCs until 31.12.2015. From 01.01.2016 onward the above mentioned EU decree opens a loop-hole because the decree demands EUCs to be regulated on a national level as self-balancing vehicles. In Germany there is only an old law from 2009 regulating Segways but it does not contain anything about EUCs! I want to insure my EUC, but insurance companies only insure type approved vehicles. Today I faxed 30 insurance requests to different companies. Maybe I'm lucky and one agrees to insure the EUC - if not I need to sue one of the companies in order to get insurance... Is it possible to get insurance for EUCs in Italy? Edited June 9, 2018 by Gunthor
FULspeed
16 hours ago, Gunthor said: I argue with a legal conception of a lawyer (Grosskopf) concerning EU decree 168/2013 Dear @Gunthor, thanks for the info. I have a question, however; I quickly read the above decree (I'm not a legal expert) but I noticed that at the beginning of the text is specified: Article 2: This Regulation does not apply to the following vehicles: .... (i) self-balancing vehicles; and in the Definitions: Article 3: .... (71) ‘self-balancing vehicle’ means a vehicle concept that is based on an inherent unstable equilibrium and that needs an auxiliary control system to maintain its balance, and which includes powered one-wheel vehicles or powered two-wheel, two-track vehicles; So can I ask you how could you use this decree with your problem with the police? Which part allowed you to get back your wheel without consequences? Thanks!
Gunthor
Hi @FULspeed, you found the essential part in the decree: "does not apply to the following vehicles:... (i) self-balancing vehicles". However it not only does not apply to self-balancing vehicles, it also does not apply to vehicles with a maximum design speed not exceeding 6 km/h (Article 2.2.a)! Therefore self-balancing vehicles and vehicles with a maximum design speed not exceeding 6 km/h are TWO different vehicle type classes and Grosskopf interprets the decree in such a way that self-balancing vehicles (no matter the maximum speed) are therefore exempt from licensing! Unfortunately there is no verdict yet verifying his interpretation. But I didn't even had a chance to defend my case: The department of public prosecution closed my case and denied me legal means that would have allowed me to prevent them to do so! I think it's because they know that I would demand an official verdict. I also think that no judge dares to utter a verdict that might be later annulled by the European Court of Justice and thus stopping his career in the future. Therefore there are two ways how to get back confiscated EUCs from the German Polizei: 1.) Don't fight - believe everything the Polizei and the department of public prosecution claim and pay your fine. You may even be registered as a criminal in doing so. 2.) Fight for your rights and let them know your belief in the road traffic expertise of Grosskopf. Most-likely all charged will then be dropped because of insignificance.

I heard about an insurance a little bit more taylored on Eucs, but I've never deepened. https://www.monoruotaitalia.com/?page_id=609 I hope that you'll find a smart insurance company. gianni
Appena fermato dai vigili...

Come pensi vada a finire ?
