The only question was whether the driver was going to let rider go first. There is no way the rider could be certain in this scenario. Since the rider was never in front of the car, it would have been way too risky to assume the driver would yield. If you expect everybody in traffic to act correctly, you are eventually making collision a certainty. Don’t give up the power to determine your own level of safety. Others don’t deserve it. This. After many years of riding (and crashing) motorcycles, I have learned to accept fault when I am not riding defensively. Cyclists & EUC riders who end up as roadkill have never argued a case in traffic court as far as I know, so it’s all about common sense defensive driving. I don’t ride in blind spots - Period. If it CAN HAPPEN, IT WILL HAPPEN….eventually. Here’s some reality: No car driver is likely to ever look over their shoulder to check their blind spot next to a BIKE LANE, unless they see the biker approaching from behind first. This driver was also clearly distracted by the unsafe cyclist traveling in the wrong direction, which I believe contributed to this accident. I don’t think the car driver ever saw the EUC rider before he flew over the hood. So in a nutshell, I would blame myself for this accident, had it been me in this situation, regardless of traffic laws. I take steps to ensure my own safety today, instead of leaving that responsibility with anonymous drivers. Numerous videos show riders without gear crashing at the highest cut out speeds, but surviving. The four known EUC deaths have involved vehicles. The closest known near death caused by an EUC would be the child crossing in NYC. And all the indoor fires in homes at night. Seems remarkably fortunate thus far. The car should always be checking his blind spot before turning , however the rider approached the stopped car and entered the blind spot and stayed there. There is no way to see the rider from the mirrors in that position so without turning his head to double check his blind spot he probably didn't even see the rider. Also the rider should have noticed the directional that you can clearly see in the video because the camera is positioned behind his eye line as you can see his glasses in the vid. But yeah, even though driver is at fault, the EUC rider was taking a massive risk, and we saw the almost inevitable result in the circumstances. Right after the lock has been grinded through, immediately take off with the bike. With the video of the theft in hand, you should be able to turn the bike into the police afterwards.
